These policies govern all interactions, purchases, bookings, and engagements with House of Lande LLC, a limited liability company doing business as HOUSE OF LANDE, LANDE, and Daphlande. These terms apply across all platforms, websites, and trading names operated by House of Lande LLC, including HOUSE OF LANDE, LANDE (houseoflande.com), and Daphlande (daphlande.com). By engaging with our services, purchasing our work, or accessing any of our platforms, you agree to the terms outlined below. Please read carefully.

House of Lande LLC serves clients globally across North America, Europe, the United Kingdom, Central and South America, Asia, and Africa. Where local consumer protection, privacy, or data laws grant you additional rights beyond what is stated here, those rights are not excluded by these terms. Region-specific provisions are outlined in Section 12.

1. Terms & Conditions

1.1 About House of Lande LLC

House of Lande LLC ("the Studio," "we," "us," or "our") is an interdisciplinary creative studio providing fine art, ceramics, textile works, spatial and interior design, experiential event production, creative direction, brand consulting, editorial curation, workshop facilitation, and related creative services. We operate under the trading names HOUSE OF LANDE, LANDE, and Daphlande.

1.2 Acceptance of Terms

By accessing our website, purchasing products, booking services, attending events, or engaging with us in any commercial capacity, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please refrain from using our services.

1.3 Eligibility

You must be at least 18 years of age to purchase, book, or enter into any agreement with the Studio. By engaging with us, you represent that you meet this requirement.

1.4 Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated terms.

2. Services & Scope of Work

2.1 Service Offerings

The Studio provides the following categories of services and products:

  • Fine art, ceramics, textile works, and original mixed-media objects

  • Digital products including prints, downloadable files, and editorial content

  • Interior and spatial design consulting and direction

  • Experiential event production, design, and coordination

  • Creative direction and brand consulting (retainer and project-based)

  • Workshop and class facilitation

  • Editorial curation including magazines, photo books, and cultural publications

  • Cultural vendor sourcing and community programming

2.2 Custom & Commission Work

All custom commissions, bespoke ceramics, personalized textile works, and tailored design projects are considered unique engagements. Terms specific to custom work will be outlined in a separate written agreement or project proposal prior to commencement.

2.3 Project Proposals & Agreements

For service-based engagements (creative direction, interior design, event production), the Studio will provide a written proposal outlining scope, deliverables, timeline, and fees. Work will not begin until a signed agreement and deposit are received.

3. Pricing, Payment & Deposits

3.1 Pricing

All prices are listed in US Dollars (USD). Prices are subject to change without notice. The price at time of purchase or booking confirmation is the price that applies to your order.

3.2 Payment Methods

We accept major credit and debit cards, PayPal, bank transfers, and other payment methods as noted at checkout. All transactions are processed securely through our payment processors.

3.3 Deposits

Service-based engagements (event design, interior design, creative direction retainers) require a non-refundable deposit of 50% of the total project fee to reserve your date and begin work. The remaining balance is due upon project completion or as outlined in the project agreement.

3.4 Late Payments

For retainer and project-based clients, invoices are due within 14 days of issuance unless otherwise agreed in writing. Late payments may result in a pause of services and a late fee of 1.5% per month on the outstanding balance.

3.5 Taxes

Applicable sales tax will be applied to product purchases based on the shipping destination. Clients are responsible for any taxes, duties, or import fees applicable in their jurisdiction.

4. Refund, Return & Exchange Policy

4.1 General Refund Window

We offer refunds within 7 days of purchase or booking for eligible items and services, provided the item is in its original condition and the request is submitted to us in writing at hello@houseoflande.com within the refund window.

4.2 Non-Refundable Items & Services

The following are strictly non-refundable under any circumstances:

  • Custom commissions, personalized ceramics, bespoke textile works, or any item made specifically for the client

  • Digital products and downloadable files once accessed or downloaded

  • Deposits on service engagements (event design, interior design, creative direction)

  • Workshop and class fees once the event has taken place

  • Shipping and handling fees

4.3 Original Art & Physical Objects

Original artwork, ceramics, and textile works are eligible for return within 7 days of delivery if the item arrives damaged or materially different from its description. Items must be returned in original packaging and condition. Buyer is responsible for return shipping costs.

4.4 Damaged or Defective Items

If your order arrives damaged, please contact us within 48 hours of delivery with photographic evidence. We will assess the claim and offer a replacement, store credit, or refund at our discretion.

4.5 Exchanges

Exchanges are offered on a case-by-case basis for non-customized physical items within 7 days of delivery. Please contact us to initiate an exchange request before returning any item.

4.6 Refund Processing

Approved refunds will be processed to the original payment method within 7–10 business days. Processing times may vary depending on your financial institution.

5. Cancellation Policy

5.1 Workshop & Event Bookings

Cancellations made 14 or more days before the event date will receive a full refund minus any payment processing fees. Cancellations made 7–13 days before the event will receive a 50% refund or the option to transfer to a future event. Cancellations made less than 7 days before the event are non-refundable. No-shows are non-refundable.

5.2 Service Engagements (Creative Direction, Interior Design, Event Production)

If a client cancels a service engagement after a deposit has been paid, the deposit is forfeited. If the client cancels after the project has commenced, they are responsible for fees proportional to work completed to date, as determined by the Studio.

5.3 Studio-Initiated Cancellations

In the unlikely event that the Studio must cancel a workshop, event, or service engagement, clients will receive a full refund or the option to reschedule. The Studio is not liable for any consequential costs incurred by the client as a result of a Studio-initiated cancellation.

5.4 Force Majeure

Neither party shall be liable for delays or cancellations caused by circumstances beyond reasonable control, including but not limited to natural disasters, illness, government action, or other force majeure events. In such cases, the Studio will work in good faith to reschedule or provide credit.

6. Shipping & Delivery

6.1 Processing Times

Original art and physical objects are typically shipped within 5–10 business days of payment confirmation unless otherwise noted. Custom and commission work timelines are outlined in the project agreement.

6.2 Shipping Carriers & Costs

Shipping costs are calculated at checkout based on weight, dimensions, and destination. The Studio ships domestically and internationally. Expedited shipping options may be available upon request.

6.3 Risk of Loss

Risk of loss and title pass to the buyer upon delivery to the carrier. The Studio is not responsible for lost, stolen, or delayed shipments once the package has been handed to the carrier. We recommend purchasing shipping insurance for high-value items.

6.4 International Shipping

International buyers are responsible for all customs fees, duties, and import taxes. Delivery times for international orders may vary and are outside of the Studio's control.

8. Privacy Policy

8.1 Information We Collect

We collect information you provide directly, including name, email address, mailing address, payment details, and any project-related information shared during consultations or bookings. We may also collect usage data through website analytics.

8.2 How We Use Your Information

Your information is used to:

  • Process orders, payments, and bookings

  • Communicate about your project, order, or inquiry

  • Send newsletters and Studio updates (with your consent)

  • Improve our services and website experience

  • Comply with legal obligations

8.3 Data Sharing

We do not sell, rent, or trade your personal information. We may share data with trusted third-party service providers (payment processors, shipping carriers, email platforms) solely for the purpose of fulfilling your order or service. All third parties are required to maintain the confidentiality of your data.

8.4 Data Retention

We retain your personal data for as long as necessary to fulfill the purposes outlined in this policy, comply with legal obligations, and resolve disputes.

10. Limitation of Liability & Disclaimers

10.1 Limitation of Liability

To the fullest extent permitted by law, House of Lande LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, products, or website, even if advised of the possibility of such damages.

10.2 No Guarantees

While we are committed to delivering exceptional creative work, the Studio does not guarantee specific outcomes, results, or commercial success from any creative direction, design, or consulting engagement.

10.3 Third-Party Links

Our website and editorial content may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any third-party sites.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These terms are governed by the laws of the United States and the state in which House of Lande LLC is registered, without regard to conflict of law principles.

11.2 Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If resolution cannot be reached informally, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association before pursuing litigation.

11.3 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12. International & Regional Compliance

House of Lande LLC operates globally and is committed to respecting the consumer protection and data privacy rights of clients in all regions. The following provisions apply to clients based in their respective regions and supplement — but do not replace — the general terms above.

12.1 European Union & European Economic Area (GDPR)

If you are located in the European Union or European Economic Area, your personal data is processed in accordance with the General Data Protection Regulation (GDPR). The following applies:

  • Lawful Basis for Processing: We process your personal data on the basis of contractual necessity (to fulfill your order or service), legitimate interest (to improve our services), and consent (for marketing communications).

  • Right to Access: You may request a copy of the personal data we hold about you at any time.

  • Right to Erasure: You may request deletion of your personal data, subject to legal obligations requiring us to retain certain records.

  • Right to Portability: You may request your data in a structured, machine-readable format.

  • Right to Object: You may object to processing based on legitimate interest, including direct marketing.

  • Right to Rectification: You may request correction of inaccurate or incomplete data.

  • Data Transfers: Where your data is transferred outside the EU/EEA, we ensure appropriate safeguards are in place, including Standard Contractual Clauses where required.

  • Statutory Cancellation Right: EU/EEA consumers have a statutory right to cancel purchases of physical goods within 14 days of delivery and digital goods within 14 days of purchase (before download or access). This right does not apply to custom or personalized items.

  • VAT: Prices displayed may not include VAT applicable in your country. EU buyers may be subject to local VAT at checkout.

12.2 United Kingdom (UK GDPR & Consumer Rights Act 2015)

If you are located in the United Kingdom, your data is processed in accordance with the UK GDPR as retained in UK law following Brexit. All rights outlined in Section 12.1 apply equally to UK residents. Under the Consumer Rights Act 2015, UK consumers are entitled to a 14-day statutory cancellation window for eligible purchases. Custom and personalized items are exempt from this right.

12.3 Canada (PIPEDA)

If you are located in Canada, your personal data is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. You have the right to access and correct your personal information held by us. We collect only the information necessary to fulfill your order or service and do not share it with third parties without your consent, except where required by law. Quebec residents are additionally protected under Law 25 (Bill 64), and may request information about how their data is used and to whom it is disclosed.

12.4 Brazil (LGPD)

If you are located in Brazil, your personal data is processed in accordance with the Lei Geral de Protecao de Dados (LGPD). You have the right to confirm the existence of processing, access your data, correct incomplete or inaccurate data, request anonymization or deletion, request information about third parties with whom data is shared, and revoke consent at any time. 12.5 Central & South America (General)

Clients in Central and South American countries outside of Brazil are served under these general terms. We are committed to responsible data handling and will comply with applicable national privacy laws in your country to the extent they apply to our services. Where local law grants you additional consumer rights, those rights are honored. Contact us if you have questions about how your data is handled in your jurisdiction.

12.6 Asia

Clients located in Asia are served under these general terms. We acknowledge and respect regional privacy frameworks including but not limited to Japan's Act on the Protection of Personal Information (APPI), South Korea's Personal Information Protection Act (PIPA), Singapore's Personal Data Protection Act (PDPA), India's Digital Personal Data Protection Act (DPDPA), and applicable laws in other jurisdictions. Where local law grants you rights beyond those stated here — including rights to access, correct, or delete your personal data — those rights apply. 12.7 Africa

Clients located in Africa are served under these general terms. We recognize applicable regional and national data protection frameworks including South Africa's Protection of Personal Information Act (POPIA), Nigeria's Nigeria Data Protection Act (NDPA), Kenya's Data Protection Act, and other applicable national laws. 12.8 Taxes, Duties & Import Fees (Global)

All international orders may be subject to customs duties, import taxes, and local fees upon arrival in your country. These charges are the sole responsibility of the buyer and are not included in our pricing or shipping fees. We are unable to predict or control these charges. We recommend contacting your local customs authority for guidance before placing an order.

12.9 Currency & Pricing

All prices are listed in US Dollars (USD). International clients are responsible for any currency conversion fees charged by their bank or payment provider. Prices may be displayed in local currency on certain platforms for convenience, but transactions are processed in USD unless otherwise stated.
